Definitions
A GolfBooker User (GBU) is defined as such when he/she uses the GolfBooker website pages to browse and/or confirm the purchase golf tee times or hotel rooms and by accepting the GolfBooker Terms & Conditions.
A GolfBooker Client (GBC) is defined as such when he/she confirms the purchase a combination of both hotel and golf tee times and by accepting GB Terms & Conditions.
General
GBUs and GBCs of GolfBooker (GB) websites agree that use of GolfBooker websites is solely at their own risk. GB disclaims all warranties of any kind, expressed or implied, including and without limitation any warranty of merchantability or non-infringement. Without limiting the generality of the foregoing statements, GB makes no warranty that its websites will meet GBC or GBU requirements, or that the service will be uninterrupted, timely, totally secure, or error free; nor does GB make any warranty as to the results that may be obtained from the service or as to the reliability of any information obtained through the website. No advice or information, whether oral or written, obtained by GBUs or GBCs from GB or in the course of using its websites, shall create any warranty not expressly made herein. GBUs and GBCs acknowledge and agree that any material and/or data downloaded or otherwise obtained through the use of the service is done at their own risk. GBUs and GBCs are solely responsible for any damages to their computer system or loss of data that results in the downloading of any files on the service or any external links available on the service.
Indemnification
GBUs and GBCs agree to indemnify and hold GB, its officers, owners, agents, and any employee harmless from any claim or demand made by any third party due to or arising out of the use of its websites.
Copyright
All content included on GB websites, such as text, graphics, logos, button icons, images, audio clips, and software, is the property either GB and protected by English and international copyright laws. The compilation (meaning the collection, arrangement, and assembly) of all content its websites is the exclusive property of GB. All software used on GB websites is the property of GB or its software suppliers and protected by English and international copyright laws. Any reproduction, modification, distribution, transmission, republication, display, or performance of the content on its websites is strictly prohibited.
Limitation of Liability
GB shall not be liable for any direct, indirect, incidental, special or consequential damages arising out of or relating to this agreement, resulting from the use or the inability to use its websites or messages received or products or services rendered or resulting from unauthorized access to or alteration of the GBU and GBC transmissions or data, including but not limited to damages for loss of profits, even if GB has been advised of the possibility of such damages.
GBC complaints concerning combined GB Hotel & Golf Tee Time Packages must be received immediately in writing and in any event within 28 days of the end of any arrangements booked through GB. GB will not accept any liability if not so notified. GB maximum liability to GBCs if we are found to have been at fault in relation to any service GB provides is limited to the commission GB has earned or are due to earn in relation to the booking in question.
Applicable Law
GB websites are created and controlled by GB in the UK. As such, the laws of England will govern these disclaimers, terms, and conditions, without giving effect to any principles of conflict of laws. GB reserves the right to make changes to its websites and these disclaimers, terms, and conditions at any time.
Availability
GB provides services on a "subject to availability" basis.
If a requested tee time at a golf club cannot be confirmed due to lack of availability of tee times at the club GB will not charge a booking fee.
In such cases GBUs credit cards will not be charged.
Tee Times
Whilst GB does everything possible to confirm requested tee times hotels/golf courses reserve the right to alter preferred tee times and therefore should tee times not be available GB will offer the nearest possible alternative. As tee times are based on playing in four-balls pairings with other golfers may be necessary.
Dresss Code
Appropriate dress and footwear should be worn at all times on the course and in the clubhouse as laid down by the relevant golf unions. GB accepts no responsibility in any ruling by any hotel/golf course which may render any golfer unable to play due to inappropriate attire.
Handicap Certificates
Some hotels/golf courses require handicap certificates before accepting visitors. GB accepts no responsibility for golfers refused access to courses if it is judged that they do not display the required golfing standards for participation.
Golf Course Condition
GB accepts no responsibility for the condition of participating golf course included on its websites.
Pricing
GB reserves the right to increase the price of any tee time, hotel room rate as advertised on its website at any time before a booking is confirmed. Any price changes will be clearly advised to you at the time of booking. Any subsequent reduction in prices due to special offers advertised will not apply to confirmed bookings.
Payment
Payment may be made via GB website/ website pages by VISA, MasterCard or American Express card.
Golf Tee Time Only Bookings
GBUs agree that GB may, when applicable and when outlined at the time of booking, charge a booking fee (deposit) to the user's credit card per golfer for each tee time reservation made via the GB websites.
Such booking fees (deposit) are non-refundable and will be charged to user credit cards regardless of whether the round of golf is played or cancelled.
GBUs authorise GB to transmit client name, address, E-mail address and credit card information to the golf course at which a reservation is made.
GBUs acknowledge that the golf course or its operators may use GB client's credit card to guarantee the reservation.
Hotel Only Bookings
GBUs agree that GB may, when applicable and when outlined at the time of booking, charge a booking fee (deposit) to the user's credit card per person for each individual reservation made via the GB websites.
Such booking fees (deposit) are non-refundable and will be charged to user credit cards regardless of whether the room reservation is taken up or cancelled.
GBUs authorise GB to transmit client name, address, E-mail address and credit card information to the golf course at which a reservation is made.
GBUs acknowledge that the golf course or its operators may use GB client's credit card to guarantee the reservation.
Combined Hotel & Golf Tee Time Bookings
A variable booking charge (deposit) of the combined tee time and hotel package is payable by GBUs on confirmation of booking by GB.
Full payment must be made by GBUs/ GBCs 60 days in advance of departure date except in the case of a booking which is made within the 60-day period. In such cases full payment must be made on the day of booking confirmation. GB reserves the right to cancel bookings not paid for on time.
Credit Card Charges
GB accepts no liability for any charge made to GBCs or GBUs by credit card companies for payment transaction or any other reason.
Cancellation
Golf Tee Time Only Bookings
Golf tee time bookings made through GB must be cancelled in accordance with the relevant golf course cancellation policy. This must be done in writing in adherence to the tee time cancellation procedure on the GB website. In the case of cancellations not made in accordance with the course cancellation policy the course may charge the user's credit card the entire green fee for all rounds initially reserved.
Hotel Room Only Bookings
Hotel Room bookings made through GB must be cancelled in accordance with the relevant hotel cancellation policy. This must be done in writing in adherence to the hotel room cancellation procedure on the GB website. In the case of cancellations not made in accordance with the hotel cancellation policy the hotel may charge the user's credit card the entire green fee for all rooms initially reserved.
Combined Hotel & Golf Tee Time Bookings
Cancellation charges will apply as follows on receipt of written or emailed notification of cancellation in accordance with the cancellation policy procedure on the GB website:
For cancellations received more than 60 days prior to the 1 st day of the package – 30% charge
For cancellations received in the period 30-59 days prior to the 1 st day of the package – 50% charge
For cancellations received in the period 1-29 days prior to the 1 st day of the package – 100% charge
Changes & Alterations
An administration fee of £25 sterling will be payable for each change made to itinerary after initial deposit payment has been made.
Passport, Visa and Health Requirements
The Client is responsible for making the necessary applications and to comply with any regulations governing entry to any relevant country.
No refunds will be made due to inabililty to travel because of invalid passport documentation.
Complaints Procedure
Any Client who is dissatisfied with any aspect of his vacation package arrangements must notify GB, the relevant Hotel or Golf Course as soon as possible so that the Hotel of Golf Course has an opportunity to resolve any problems as soon as possible.
Compensation claims in relation to a package must be made in writing outlining the nature of the complaint within 90 days of the last day of the vacation package to:

Data Protection
GB reserves the right to provide Client Information to suppliers that might be located outside the UK and/or EU, to enable the operation of the services requested by the Client.
Insurance
Users of GB websites and services are responsible for taking out adequate travel insurance. GB accepts no liability in the event of a user not having adequate insurance cover.
Force Majeure
Except where otherwise expressly stated in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by or you otherwise suffer any damage or loss as a result of "force majeure". In these Terms & Conditions, "force majeure" means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.
